Have you received a notification that you've been given a traffic fine? If you've been fined, chances are you won't agree with it or feel like paying the penalty they've just given you.

Even though the officer reporting the offense is presumed to be telling the truth, the fact that you've received a fine doesn't mean you've broken traffic regulations.

In many cases, whether out of unfamiliarity, to avoid trouble, or to take advantage of the early-payment discount, people tend to just pay it. If you decide to pay it, make sure the fine really does come from the DGT and that all the information is correct. If you weren't the one driving,

identify the driver. Remember that the DGT only sends fines by postal mail or electronic notification. The process can be done online, in person, or by phone. The necessary documentation is available on the DGT's website, under the "Application Forms" section.

If you want to appeal a fine, the first thing you need to know is what the penalty is for. In other words, find out the reason you were fined.

How to appeal traffic fines?

Below are the most important things to keep in mind to successfully appeal a penalty:

Fines with a discount:

Any fine is a blow to our wallets. That's why the 50% discount is a hook that catches many people who've been fined. Why? When we take the discount and pay the fine, we lose the right to file an appeal. That way, we've closed off every option we had to defend ourselves.

Deadline for appealing traffic fines:

Once we've received the penalty notice by certified mail, the deadline for filing an appeal and submitting arguments begins. We have 20 calendar days. During this period, you'll need to submit any evidence you consider relevant so that the fine can be declared void.

Appeal rights notice:

Any administrative penalty notice must, by law, include a section explaining what appeals can be filed and the deadline for doing so. If the notice you received doesn't include this section, it's invalid, and the authorities are required to send it again. In this case, the resulting delay can work in our favor and help the fine expire.

Notification deadline:

It's not just the person who's been fined who has to meet deadlines — the authorities do too. By law, the sanctioning body has 3 months to notify the offender of minor penalties; 6 months for serious ones, and a year for very serious ones. If the fine reaches your home later than that, it's invalid, since the offense has expired, and you won't have to pay it.

Collection deadline:

Both the DGT and local councils have deadlines for collecting a fine. Specifically, they have one year to do so. After that time, the penalty has expired and they can no longer demand payment.

Driver identification:

If the DGT didn't notify you of the offense on the spot and instead sends the penalty to your home, the first thing you should receive by law is a request to identify the driver. If you don't receive this documentation, you could request that the fine be voided for arbitrarily assigning responsibility.

Check the details:

Something as simple as checking that all the details on the notice are correct can help us invalidate the fine. An error in the name, surname, or license plate makes the penalty void. Also make sure the fine actually comes from the DGT.

Officer identification:

Every fine must include the identification of the officer who issued the notice. In addition, one step that can help our appeal is requesting confirmation of the officer's account of events. In most cases, the slowness and disorganization of the authorities can cause the file to get lost or arrive late, causing the fine to expire.

What happens if I lose my fine appeal?

If, despite our arguments, the fine is still considered valid by the authorities, we have two options: pay it or appeal the penalty further. If you decide to appeal, you'll need to go through the administrative courts. Most people have a certain fear of legal proceedings, however, this route tends to produce very good results in terms of fines being overturned.
